Terms and conditions

These terms apply to BackSound Stream: the pre-order, the subscription, the player and the equipment we supply with it. Where your own agreement says something different, that agreement prevails.

1. Who we are

BackSound Stream is a service of Backsound B.V., Snelliusweg 65, 6827 DG Arnhem, the Netherlands, Chamber of Commerce number 99370328. Reach us at info@backsound.nl and +31 88 4259888.

2. What the service is

We supply music for business use: a player, access to the catalogue and the features that come with your package. You play the music in your own business premises.
Which features belong to which package is set out on the pricing page. We may add and improve features; if we remove something essential to your package, we will say so in advance and you may cancel as of the date the change takes effect.

3. The pre-order

A pre-order is a place in the queue, not a subscription. Nothing is charged and you are not committed to anything.
What a pre-order does do:

we contact you as soon as your player is ready;
•
you join the first rollout, in order of registration;
•
you get 2 months free when your subscription starts.

4. If the launch moves

We are aiming for 2 November 2026. If that slips, we will tell you and your place in the queue stays; you may also withdraw your pre-order free of charge. A pre-order does not entitle you to delivery on a particular date.

5. Subscription and term

The subscription starts on the day your player works. Paying monthly, it is cancellable month by month with one month's notice. Paying yearly, the contract runs for a year with three months' notice; if you do not cancel in time it is renewed for another year.
You can cancel in writing or by e-mail to info@backsound.nl. We confirm every cancellation; if you have no confirmation within five working days, please contact us — it did not reach us.

6. Prices and payment

All amounts are exclusive of VAT. Dutch customers pay 21% VAT; for business customers outside the Netherlands, VAT is reverse-charged.
We invoice monthly or yearly, as you choose when signing up; yearly is cheaper. Payment is by direct debit or through the payment link on the invoice.
If a payment does not arrive, we send a reminder first. If it is still not paid after that, we may suspend the service until it is. Suspension does not release you from paying for that period.
We may adjust prices annually. We announce an increase at least a month in advance; you may then cancel as of the effective date.

7. Buma/Stemra and Sena are NOT included

Any business that plays music to the public also needs a public performance licence from Buma/Stemra and Sena. You arrange that yourself via mijnlicentie.nl and it is separate from your subscription — with us and with any other provider.
Our subscription covers the right to stream the music commercially. It does not cover your performance licence, and we are not liable for the consequences of not having one.

8. How you may use the music

The music is for your own business premises. You may not:

retransmit, broadcast or make the music available online;
•
make recordings or copy files outside the player;
•
share your account with another business or location;
•
use the player on more playback points than your package allows.

9. Equipment

If you buy equipment from us — a touchscreen, speakers or an amplifier, for instance — it is yours once paid for. The usual manufacturer's warranty applies to all equipment.
The music computer in the STREAM PRO + PC plan is not bought: it belongs to the subscription and remains ours for as long as it runs. We replace it with a faster one every three years. Once the subscription has run for five years, the music computer becomes yours at no extra cost. If you cancel sooner, the music computer comes back to us.
On-site installation is a separate, one-off item; the amount is on the pricing page. You can reschedule an appointment free of charge up to 24 hours beforehand.

10. Availability and maintenance

We do our best to keep the service running, but cannot guarantee uninterrupted availability. The player keeps playing if the internet drops.
We announce planned maintenance in advance and schedule it outside opening hours wherever we can.

11. Liability

If something goes wrong that we are liable for, our liability is limited to what you paid for the service in the preceding twelve months.
We are not liable for consequential loss, such as lost revenue. These limits do not apply in the case of intent or deliberate recklessness on our part.

12. Your data

How we handle your data is set out in our privacy statement.

13. Changes to these terms

We may amend these terms. We announce changes to your disadvantage at least a month in advance; you may then cancel as of the effective date. The date at the top of this page shows when the text last changed.

14. Governing law

Dutch law applies to these terms. Disputes go to the Gelderland district court, unless the law designates another court.
If you have a complaint, raise it with us first at info@backsound.nl. In practice that resolves almost everything.
